Introduction

Product Forge, Inc., (“Product Forge,” “Company,” “us,” or “We”) respects your privacy and is committed to protecting it through this policy. Product Forge values the confidence of users of our Software, and believe it is important for you to know how we handle the information we receive from or about you.

This policy describes the types of information we may collect from you or that you may provide when you use our services, visit our website at productforge.ai/, related websites, subdomains, application tools (including but not limited to mobile apps), software, or other services (collectively, the “Software”).

This policy applies to information we collect:

  • On this Software, including on or through any website or software application related to this Software.
  • In email, text, and other electronic messages between you and this Software.
  • Through mobile and desktop applications you download to access this Software.
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from the Software. Customers are solely responsible for collection of data from employees and obtaining and maintaining the appropriate consents and safeguards. 

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Software. By accessing or using this Software, you agree to this privacy policy. This policy may change from time to time. Your continued use of this Software after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates. 

Children Under the Age of 18

Our Software is not intended for children under 18 years of age. No one under age 18 may provide any information to us through use of the Software. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this Software, register on the Software, make any purchases through the Software, use any of the interactive or public comment features of this Software, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at hello@productforge.ai.

As you interact with us, we may collect information about you from the following sources:

  • Directly from you, through interactions such as, setting up an account, filling in forms, including those on the Site, when you carry out transactions with us, when you communicate with us (including by submitting content, soliciting content, or email and SMS), when you use our Software, if you report a problem with our Software.
  • From technology when you visit our Site. From parents, subsidiaries, and affiliates.
  • From third parties or public sources, such as, Software providers, data brokers/resellers of data, business partners, advertising networks, social media platforms and networks, public websites, government entities that maintain public records, or information that you submit to a public forum.

We may combine information that we receive from the sources described in this Statement, including third party sources and public sources, and use or disclose it for the purposes described below.

What Information Do We Collect?

We collect the following information:

  • Your contact details, such as name, e-mail address, password, birthdate, phone number and zip code
  • Demographic information, such as gender, general location, hobbies and interests
  • Account information, such as username, password and e-mail address and account preferences
  • Payment information, such as electronic payment account details (Venmo, Paypal, etc.)
  • Information about your team, such as email address and password, connections with users on the same team
  • Inputted business data, such as product information, personas, persona information, comments and feedback, technical implementation details, product images, and the like
  • Communications with us, such as customer support calls and emails Information about how you use the Software
  • Information collected automatically through technology when you use our Software, such as your IP address; browser type and language; operating system; domain server; type of computer or device; and other information about the device you use to access our Site or utilize our Software; as well as internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with our Site, Software or advertisements
  • Photos, video/audio clips or written comments that you provide through the Software
  • Professional or employment information, such as your place of work, title, department
  • Inferences, drawn from any of the above to create a profile about our users

Information We Collect Through Automatic Data Collection Technologies  

As you navigate through and interact with our Software, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  •  Details of your visits to our Software, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Software.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

The information we collect automatically is only statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Software and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our Software according to your individual interests.
  • Use of our Services.
  • Recognize you when you return to our Software.

As an example, the technologies we may use for this automatic data collection may include or be similar to:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Software. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Software. 
  • Web Beacons. Pages of the Software and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity). 
  • Pixels. A pixel is a tiny snippet of code that gathers information about visitors on a website, which may include how you browse, what type of ads you click on, and other behaviors. 

We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or you provide to us.

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on the Software are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. 

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Software and its contents to you.
  • To provide you with information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account or subscription, including expiration and renewal notices.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes to our Software or any products or services we offer or provide through it.
  • To allow you to participate in interactive features on our Software.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

Retention of Your Information

Your information is retained while you are a current or potential customer or as needed to provide our services to you. We will retain and use Your personal data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies and as reasonably necessary and proportionate to provide our services and to achieve the purposes discussed herein. We will also retain usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect or you provide to:

  • Affiliated companies: We may share some or all of your information to our parent companies, subsidiaries, and affiliates.
  • Service providers: We also may transmit or share your personal information with its third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and other technology and services required to design, improve, operate and maintain the Software, as well as other third party services, such as payment an fulfillment.
  • Analytical insights. We may share your data and information with large language models or artificial intelligence to, for example, generate content, view insights, connections, predictions, and patterns. We do not use your data to train any external third-party large language models
  • Professional Advisors. We may share your information with our accountants, lawyers, and other professional advisers that assist us in carrying out our business activities.
  • For legal, safety and security reasons: We may disclose your information to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We also may share such information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, Master License Agreements or as otherwise required by law.
  • With third parties regarding corporate changes: We might buy or sell businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the information we collect may be part of the transferred assets.
  • Consent. We may share personal information that we hold about you with your consent or at your direction with non-affiliated third parties.

Product Forge also may provide de-identified or aggregated data, including non-personal, summary or group statistics about our customers, sales, traffic patterns, and related Site information to reputable third-party vendors and customers.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. Where applicable, we may provide you with the following control over your information: 

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Disclosure of Your Information for Third-Party Advertising. If we plan to share your personal information with unaffiliated or non-agent third parties for promotional purposes, we will provide you the option to opt-out by logging into the Software and adjusting your user preferences in your account profile or by sending us an email with your request to hello@productforge.ai.
  • Promotional Offers from Company. If we plan to use your contact information to promote our own or third parties’ products or services, we will provide you the option to opt-out by logging into the Software and adjusting your user preferences in your account profile or by sending us an email stating your request to hello@productforge.ai. This opt-out does not apply to information provided to Company as a result of a product purchase, warranty registration, product service experience or other transactions.
  • Targeted Advertising. If we plan to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, we will provide you the option to opt-out by adjusting your user preferences in your account profile or by sending us an email stating your request to hello@productforge.ai. 

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. 

Accessing and Correcting Your Information

You can review and change your personal information by logging into the Software and visiting your account profile page.

You may also send us an email at hello@productforge.ai to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Software, copies of your User Contributions may remain viewable in cached and archived pages.  Proper access and use of information provided on the Software, including User Contributions, is governed by our Terms of Use.

Data Security

We have implemented industry standard measures intended to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Software, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Software like comments on blog posts. The information you share in public areas may be viewed by any user of the Software.

We do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Software. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Software.

Your Rights

As previously described, you may have the right to:

  • Access your information;
  • Correct your information;
  • Delete your information;
  • Opt out of certain processing of your information;
  • Obtain a portable copy of your information;
  • Opt out of sales of your information;
  • Opt out of processing of your sensitive data;
  • Initiate a private cause of action for data breaches;
  • Opt out or control use of automated decision making of your information, and
  • Not be discriminated against for exercising one or more of these rights.

European Union’s General Data Protection Regulations (“GDPR”)

European residents may have certain rights under the European Union’s GDPR 2016/679. The GDPR is a complex regulatory scheme and we do not intend to provide every detail here. The GDPR provides the right, where applicable, to (a) access, (b) publication, (c) erasure, (d) restrict processing, (e) object to processing, (f) data portability, (g) complain to a supervisory authority, and (h) withdraw consent. You may have one or more of these rights if you are a European Resident.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the Software home page. If we make material changes to how we treat our users’ personal information, we will notify you by email to the email address specified in your account or through a notice on the Software home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Software and this privacy policy to check for any changes.
